Terms and Conditions for Prize Draw

Conditions of entry

1. This prize draw (the "Promotion") is only open to legal residents of Great Britain (England, Wales and Scotland), excluding employees and agents of (a) the Promoter or (b) government officials or (c) any company connected with the production or distribution of this Promotion, as well as any members of their immediate family (e.g., spouse, parent, child, sibling) and persons living in the same household as them, whether or not related, are not eligible to enter this Promotion.
2. Entrants must be aged 18 years or over at the time of entry. Proof of identity must be provided upon request. By entering the Promotion you are deemed to accept and be bound by these terms and conditions (the Terms and Conditions).
3. It is free to enter the promotion, however internet access is required, and entrants can enter by following the link dailymail.co.uk/bpmerewards providing their details when prompted (including full name, telephone number, email address and postcode). Only one entry will be accepted per household.
4. The Promotion will start at 00:01 on 23rd September 2024 and the closing time/date for the Promotion is 23:59 on 11th October 2024.

Winner

5. There will be one winner who will be selected in a random draw-conducted by a computer process that produces verifiably random results from all eligible entries, held on 14th October 2024. Reasonable efforts will be made to contact the provisional winners, but it is each entrant’s responsibility to monitor their email address (including spam folder). The winner will be notified by the Promoter by email within 4 weeks of this date and will be given details of how to accept their prize. Failure by the winner(s) to accept the prize in the manner specified within one week of the Promoter's email will make any claim invalid and the Promoter will then select another winner (again selected randomly in a draw) from all remaining eligible entries who will be contacted as above.
6. The prize is a Sports Road Trip comprising of:
   • A total of 7 day fully inclusive car hire
   • 7 nights' accommodation along your route
   • Breakfast for two people each morning in each hotel’s restaurant
   • Top tickets to 3 x sporting events of the winner’s choice for two people
   • 1 Apple iPad Air 2024 11 Inch Wi-Fi 128GB
   • Additional terms and conditions include:
     • Travel is subject to availability at the discretion of NDL Travel and excludes bank holidays, Valentine’s day and/or Valentine’s weekend and school holiday periods (specifically the Christmas holidays, summer period holidays, spring and autumn half terms and Easter).
     • Car hire will only be available to drivers aged 25 or over with a current full clean driver’s licence for a minimum of 2 years from the date of car hire. Fully inclusive refers to unlimited mileage, collision damage waiver, theft protection, local taxes and airport fees. The driver will need to provide the car hire company with a personal credit card that has £500 - £1,000 (variant depending on company) available for a security deposit that is refundable to the driver’s credit card upon the safe return of the vehicle. The driver will be fully liable for any liability in respect of the car hire. Should the winner not wish to drive, reasonable alternative travel arrangements will be offered.
     • You will be staying in 3-4* hotels along your route, sharing a double room with en-suite bathroom on a bed and breakfast basis. If you’d prefer a twin room, we will do what we can to secure this for you, but it cannot be guaranteed.
     • Sport event tickets of the winner’s choice must be for a game in mainland UK, exclude top of the table clashes, local derby matches, semifinals, and final matches. Type of ticket and inclusions depend on the events chosen. Tickets are subject to availability at the time of booking.
     • Travel prize must be claimed and booked by the prize winner within 12 months from the date of our initial correspondence with them.
     • This promotion is not sponsored, endorsed, administered by or associated with Apple
     • Should the iPad Air be unavailable at the time of purchase for the winner, the NDL Group reserves the right to substitute with an alternative of equal or greater value. Specifications are subject to change from the manufacturer without notice.
     • iPad will be delivered within 28 working days from the date that NDL receives confirmation of the delivery address from the winner
7. For the avoidance of doubt, subject to Clause 6 above the Prize does not include any additional travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the Prize will be responsible for any such costs.
8. Gifts, prizes and other promotional items are not transferable, and can only be redeemed by the winner. They may not be re-sold and are subject to availability. The Promoter reserves the right in their reasonable discretion to substitute any gift, prize or item with a gift, prize or item of equal value.
9. The name and county of the prize winner will be available after the closing time/date of the Promotion by submitting a written request to the Promoter.
10. By entering into the Promotion, each entrant agrees that in the event of a win, their surname and county of residence may be disclosed to persons enquiring, where permitted by law. Provided no objection is received from the winner, these details list will be made available by the Promoter 4 weeks after the end of the Promotion Period, for a period of 8 weeks. To request the winner’s details, please email projects@mailmetromedia.co.uk. Without prejudice, the Promoter will provide the winner’s information to the Advertising Standards Authority on request. Entrants agree to provide reasonable cooperation to allow the Promoter to use the name and/or likeness of the winner for advertising and publicity purposes in connection with this Promotion including but not limited to publication of the winner's name and photograph on the Promoter’s websites. In addition, by submitting an entry and in consideration of the Promoter granting a right to enter the Promotion, entrants agree to grant the Promoter a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and exercise all copyright and publicity rights with respect to any materials contained in the entry (including but not limited to text, images or video materials) (the “Materials”) worldwide and/or to incorporate the Materials in other works in any media now known or later developed for the full term of any rights that may exist in the Materials. By submitting Materials to the competition, an entrant:
    1. warrants that the Materials are its own original work and that it has the right to make them available for all the purposes specified above; that it does not infringe any law; that it is not obscene or libellous; and that it does not violate the rights of any third party; and
    2. agrees to indemnify the Promoter against all legal fees, damages and other expenses that may be incurred as a result of a breach of the above warranty; and
    3. agrees to waive any moral rights in the Materials for the purposes of its submission to, and publication by, the Promoter and the purposes specified above.

Personal information

11. Any personal information provided to us during the entry process (including but not limited to your name, e-mail address, telephone number and date of birth) must be correct. We accept no responsibility for any incorrect personal information provided to us.
12. Associated Newspapers Ltd will hold your personal information in accordance with these Terms and Conditions and our privacy policy (available here: http://www.dailymail.co.uk/home/article-1388040/Privacy-Policy-Cookies.html).
13. Associated Newspapers Ltd will only share your personal information with the Promoter where you are a/the winner of the Promotion or where you have opted in to receive direct marketing from the Promoter (if relevant). The Promoter will hold your personal information as a separate controller in accordance with its privacy policy (available here: https://www.bp.com/en_gb/united-kingdom/home/products-and-services/bpme/privacy-policy.html) and shall implement and maintain appropriate technical and organisational security measures in compliance with the GDPR and any other applicable law.

General

14. The determination and decision of the Promoter on all matters shall be final and no promotional correspondence or discussion will be entered into. The Promoter reserves the right in its reasonable discretion: (a) to disqualify any claimant, competitor or nominee whose conduct is contrary to the spirit of the rules or the intention of the Promotion and to declare as void any or all of their claims or entries based on such conduct; (b) to declare as void any claims or entries resulting from any printing, production and/or distribution errors (including but not limited to any error(s) on any website of the Promoter, any game cards and/or other printed materials) or where there have been error(s) in any aspect of the preparation for or conduct of the Promotion materially affecting the result of the Promotion or the number of claimants or the value of claims; (c) to add to or to waive any rules on reasonable notice; and/or (d) to cancel the Promotion or any part of it at any stage in the event of circumstances beyond the Promoter's reasonable control.
15. No entries will be accepted in bulk, from agents or third parties.
16. To the fullest extent permitted by law (and subject to paragraph 17 below), the Promoter hereby excludes all warranties, representations, covenants and liabilities (whether express or implied) relating to this Promotion and/or the prize.
17. The Promotion is in no way sponsored, endorsed, administered by or associated with any social media platform or any other third party. All third-party trademarks and other intellectual property rights are hereby acknowledged. Use of and entry to promotions via social media platforms is always subject to the rules, terms and policies of those platforms. By participating in the Promotion, entrants are providing information to the Promoter, not to any relevant social media platform. To the maximum extent permitted by applicable law, the relevant social media platforms shall have no liability to any person in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, damages, and other liabilities.
18. Nothing in these Terms and Conditions shall exclude the Promoter's liability for: (i) death or personal injury as a result of its negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be limited or excluded by law.
19. The Promoter reserves the right, in its sole discretion, to modify, suspend or cancel the Promotion should virus, bugs, tampering, fraud or other causes beyond the reasonable control of the Promoter corrupt or hinder the administration, security or proper play of the Promotion.
20. If any of the provisions of these Terms and Conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.
21. These Terms and Conditions shall be governed by the laws of England and Wales and any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that residents of Scotland may also bring proceedings in the Scottish courts.
